ESE Capital Ltd (ESE) has been regulated since June 2008. ESE acted as an Alternative Investment Fund Manager (AIFM), for a series of unregulated funds that operated in land banking.

ESE was placed into Creditors’ Voluntary Liquidation on 1 December 2025 with Adam Price and Lane Bednash of CMB Partners UK Limited appointed as joint liquidators.

    Further to our update in December 2025, FSCS is now open to claims against ESE Capital Ltd (‘‘ESE’’).  
    If you believe you have a potential claim for compensation against ESE, you can now submit a claim using our online claim service.

    Although we are accepting claims against ESE, they will not be immediately passed to our claims processing teams for assessment. We are currently investigating the firm to determine whether claims meet the qualifying conditions for compensation, and this may take some time. 

    If you have already submitted a complaint to FOS against ESE, FOS may contact you to request your permission to transfer your file to us. You will still need to make a claim to us, however you do not need to provide us with any evidence which is already in your FOS file, provided your FOS file is transferred to us.

    Customers who made investments between 19 November 2015 and 03 December 2019 into the ESE funds noted below, would have done so via Intro Crowd Limited (‘‘Intro Crowd’’).

    During this period, Intro Crowd was an Appointed Representative of Sapia Partners LLP (‘‘Sapia Partners’’).   Sapia Partners was the principal firm and is still trading and remains FCA authorised.

    This means customers who made investments during the above period, need to make a complaint to Sapia Partners this is because ESE is not responsible for the actions of Intro Crowd Limited.  If Sapia rejects your complaint it will provide you with escalation rights to Financial Ombudsman Service (FOS).

    FSCS is not currently open to customer claims against ESE.   

    We are investigating whether there may be any valid claims. We anticipate this will be a complex investigation and we will work closely with the joint liquidators and the FCA.

    What if you also dealt with another FCA-authorised firm? 

    In some cases, FCA-authorised independent financial advisers (IFAs) may have categorised clients and distributed investment funds.

    You can check to see whether the firm you dealt with has ever been authorised by FCA by searching its online register.

    If you dealt with another FCA-authorised firm that’s no longer trading, and haven’t already made a claim against them, you can submit a claim to FSCS against that firm.  

    If you dealt with an FCA-authorised firm that’s still trading, and your complaint hasn’t been exhausted, you may have a complaint against that firm which should be taken forward.

    If your complaint is rejected by the live firm, you can take your complaint against your adviser to the Financial Ombudsman Service (FOS). 

    FSCS is aware some funds were held within SIPPs. If the SIPP provider you initially held your investment with has failed, you may be able to submit a claim to FSCS against your SIPP provider. The types of claim FSCS are able to consider against SIPP providers typically concern due diligence failings.
